These Terms of Service ("Terms") govern your use of CaptionCast ("we", "our", "us"), a real-time speech transcription and translation platform for live events operated at captioncast.io. By creating an account or using the service, you agree to these Terms.

1. Service Description

CaptionCast provides real-time audio transcription and translation for live meetings and events. The service captures audio from your browser, transcribes speech to text, translates it between supported languages, and displays captions on a shareable screen. Transcripts are stored for later review and export.

2. Accounts

You must create an account to use CaptionCast. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when registering and keep it up to date. You must be at least 18 years old to create an account.

If you create an organization, you are responsible for managing its members and their access levels. Organization owners are responsible for their team's compliance with these Terms.

3. Acceptable Use

You agree not to:

  • Use CaptionCast for any unlawful purpose or in violation of any applicable laws
  • Record or transcribe conversations without the consent of all participants where required by law
  • Attempt to reverse-engineer, decompile, or extract the source code of our services
  • Interfere with or disrupt the service, servers, or networks connected to the service
  • Use automated systems or bots to access the service in a manner that exceeds reasonable use
  • Resell or redistribute the service without our written permission
  • Transmit content that is harmful, threatening, abusive, or otherwise objectionable

4. Payment Terms

CaptionCast offers subscription plans billed on a recurring basis through Stripe. By subscribing, you authorize us to charge your payment method at the start of each billing cycle. All fees are non-refundable except where required by law or at our discretion.

We may change pricing with at least 30 days' notice. If you do not agree to a price change, you may cancel your subscription before the new price takes effect. Usage beyond your plan limits may result in overage charges or service throttling, depending on your plan.

5. Cancellation Policy

You may cancel your subscription at any time from your billing settings or by contacting us at support@captioncast.io. Cancellation takes effect at the end of your current billing period — you will continue to have access to your plan's features until then. No partial-month refunds are issued for cancellation mid-cycle.

After cancellation, your account reverts to the Free plan (30 minutes, 1 meeting per month). Your existing meetings and transcripts remain accessible. You may resubscribe at any time.

6. Refund and Dispute Policy

All subscription fees are generally non-refundable. However, we want you to be satisfied with CaptionCast. If you are unhappy with the service, contact us within 14 days of your initial subscription purchase and we will issue a full refund — no questions asked.

Refund requests after the 14-day window are handled on a case-by-case basis. We will not issue refunds for unused minutes or meetings within a billing period. If you believe you were charged in error, please contact us at support@captioncast.io and we will investigate promptly.

If you file a chargeback or payment dispute with your bank, we may suspend your account while the dispute is being resolved. We encourage you to contact us first to resolve any billing issues directly.

7. Service Availability

We strive to keep CaptionCast available and reliable, but we provide the service on a "best effort" basis. We do not guarantee a specific uptime percentage or response time for non-enterprise plans. We may perform maintenance, updates, or experience downtime that temporarily affects availability.

Transcription and translation accuracy depend on audio quality, speaker clarity, and language complexity. We do not guarantee perfect accuracy. CaptionCast should not be relied upon as the sole record for legal, medical, or other critical purposes.

8. Intellectual Property

Your content. You retain full ownership of all audio, transcripts, translations, and other content you create or process through CaptionCast. We claim no intellectual property rights over your content.

Our service. CaptionCast, including its design, code, features, and documentation, is owned by us and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

9. Limitation of Liability

To the maximum extent permitted by law, CaptionCast and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.

Our total liability for any claims related to the service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold CaptionCast harmless from any claims, damages, or expenses arising from your use of the service, your violation of these Terms, or your violation of any third-party rights, including privacy and intellectual property rights.

11. Termination

You may cancel your account at any time from your account settings. We may suspend or terminate your account if you violate these Terms or if your use poses a risk to the service or other users. Upon termination, your right to use the service ends immediately. We will retain your data for 30 days after account closure to allow for recovery, after which it will be permanently deleted.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of CaptionCast after changes are posted constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles.
